Update on Additional H-2B Visas

AmericanHort and the H-2B Workforce Coalition continue to urge the Administration to immediately make available to seasonal employers the additional 30,000 H-2B visas that it committed to releasing last month. We hope the final rule outlining the process for applying for these visas will be released shortly.

On March 29, the Department of Homeland Security announced that it plans to release an additional 30,000 H-2B visas, and that these visas would be limited to returning workers. The Fiscal 2019 Consolidated Appropriations Act authorized Congress to release up to 69,320 additional visas. 

Last week, the H-2B Workforce Coalition sent a letter to President Trump urging the Administration to release the final rule and the associated visas as expeditiously as possible.  And on April 22, the Department of Homeland Security sent a final rule to the White House Office of Management and Budget for review.  This mandatory review of federal regulations and other regulatory actions is required by several laws and executive orders.  It is the final stage in the rulemaking process before a regulation can be finalized and published in the Federal Register. So, it looks like we are close to the new visas becoming available.

We continue to urge the Administration to promptly publish the final rule and will provide our members with the details on how to apply for the additional H-2B visas as soon as the final rule is released.
